Terms of service

These Terms of Service govern all purchases, orders, bookings, services, floral products, custom designs, pickup orders, flower bar services, and related transactions provided by The Rustling Petal Co.

By placing an order, booking a service, submitting payment, or otherwise engaging The Rustling Petal Co., the customer agrees to be bound by these Terms of Service.

1. Acceptance of Terms

By purchasing products or services from The Rustling Petal Co., the customer acknowledges that they have read, understood, and agreed to these Terms of Service.

These Terms apply to all floral arrangements, seasonal collections, designer’s choice arrangements, custom orders, pickup orders, private events, flower bar services, and any other products or services offered by The Rustling Petal Co.

The Rustling Petal Co. reserves the right to update, modify, or replace these Terms of Service at any time. The version in effect at the time of purchase, booking, or payment shall govern the applicable transaction.

2. Nature of Floral Products

All floral products are handmade, perishable, and subject to natural variation. Flowers, greenery, branches, berries, and other botanical materials may vary in color, size, shape, openness, fragrance, texture, availability, and vase life.

Images shown on the website, social media, marketing materials, product listings, or prior examples are representative only. Exact replication of any arrangement, floral recipe, bloom variety, stem count, vessel, color tone, size, or design is not guaranteed unless expressly agreed to in writing by The Rustling Petal Co.

Natural variation, seasonal availability, and reasonable design differences do not constitute a defect or failure to perform.

3. Freshness and Substitutions

The Rustling Petal Co. uses fresh seasonal flowers and botanical materials selected based on availability, quality, and design suitability.

Due to seasonal availability, supplier inventory, weather conditions, transportation delays, crop conditions, market shortages, and other factors outside the control of The Rustling Petal Co., specific flower varieties, colors, branches, greenery, vessels, or materials may be unavailable at the time of fulfillment.

The Rustling Petal Co. reserves the right to make substitutions as necessary. Substitutions may include flowers, greenery, hardgoods, vessels, ribbon, wrapping, branches, display materials, or other design elements of equal or greater value, as determined by The Rustling Petal Co.

Substitutions will be made with the intent to preserve the overall style, color palette, scale, value, and design integrity of the selected product or service.

No refund, credit, replacement, discount, or chargeback is permitted solely because a substituted flower, greenery, vessel, ribbon, branch, supply, or design element differs from a product photo, inspiration image, prior example, or customer expectation.

4. Designer’s Choice Arrangements

Designer’s Choice arrangements are created at the discretion of The Rustling Petal Co. based on the selected size, price point, seasonal availability, available inventory, and design judgment.

Specific flowers, colors, vessels, greenery, branches, berries, or design ingredients are not guaranteed for Designer’s Choice arrangements.

Customer preferences or requests may be considered, but such requests are not binding unless expressly accepted in writing by The Rustling Petal Co.

Each Designer’s Choice arrangement is unique. Variations in design, flower selection, color placement, fullness, shape, and overall composition are expected and do not constitute a defect, error, or failure to perform.

5. Order Lead Time and Production

Lead times vary by product, service type, collection, season, availability, scope, and requested fulfillment date.

The lead time applicable to a particular order or service may be stated in the product listing, checkout process, invoice, proposal, booking agreement, or written communication from The Rustling Petal Co.

By placing an order, the customer acknowledges that floral products and services require advance planning, sourcing, purchasing, design preparation, administrative work, and production coordination.

Production, including sourcing and procurement, begins upon order placement unless otherwise stated in writing.

Because sourcing and preparation begin immediately after an order is placed, all orders are subject to the cancellation, refund, and final-sale terms set forth in these Terms of Service.

The Rustling Petal Co. is not obligated to accept rush orders, shortened lead times, late changes, modification requests, or requests outside the stated availability for a product or service.

The Rustling Petal Co. reserves the right to decline, cancel, or modify an order if the requested timeline cannot reasonably be fulfilled, required materials are unavailable, payment is incomplete, customer information is inaccurate, or the requested scope cannot be accommodated.

6. Pickup Policy

Customers are responsible for selecting the correct pickup date and time at checkout or confirming the correct pickup date and time in writing.

Due to the perishable nature of flowers, timely pickup is required.

Customers must arrive within 15 minutes of their scheduled pickup time. If a customer is running late, the customer must contact The Rustling Petal Co. as soon as possible.

When feasible, The Rustling Petal Co. may hold an arrangement until the end of the scheduled pickup date. Any hold beyond the scheduled pickup time is provided solely as a courtesy.

The Rustling Petal Co. does not guarantee freshness, quality, vase life, appearance, condition, or design integrity of any arrangement after the scheduled pickup time has passed.

The customer remains responsible for the order regardless of whether the order is picked up on time.

7. Missed Pickups and No-Shows

Orders not picked up on the scheduled pickup date are considered missed pickups or no-shows.

Due to the handmade and perishable nature of floral products, missed pickup orders are not eligible for refund, credit, remake, replacement, rescheduling, or transfer to a later date.

The Rustling Petal Co. may, in its sole discretion, donate, discard, repurpose, or otherwise dispose of unclaimed floral products after the scheduled pickup date has passed.

The Rustling Petal Co. may document completed orders with photographs for quality control, verification, internal records, and dispute-resolution purposes.

8. Rescheduling

Requests to reschedule pickup or fulfillment to a later date are subject to availability and must be approved in writing by The Rustling Petal Co.

Because sourcing and production begin upon order placement, rescheduling is not guaranteed.

If a rescheduling request is made after sourcing, purchasing, processing, or production has begun, the request may be treated as a new order and may require additional payment.

The Rustling Petal Co. is not obligated to remake, refresh, replace, redesign, or extend the life of floral products due to missed pickups, late pickups, customer scheduling errors, customer delays, or failure to retrieve an order at the selected time.

9. Refunds, Cancellations, and Final Sale

All floral products are handmade, custom-prepared, perishable, and created using materials that may be sourced specifically for the customer’s order.

Production, sourcing, and procurement begin upon order placement. As a result, all sales are final unless The Rustling Petal Co. determines, in its sole discretion, that a refund, credit, replacement, or other remedy is appropriate.

Refunds are not guaranteed and are issued only at the discretion of The Rustling Petal Co., except where otherwise required by applicable law.

The Rustling Petal Co. may consider a refund, partial refund, credit, replacement, or other remedy in limited circumstances, including but not limited to the following:

1. The customer receives a product that is materially damaged at the time of pickup or delivery;
2. The Rustling Petal Co. is unable to fulfill an accepted order or service;
3. The Rustling Petal Co. cancels a service for reasons within its control; or
4. The Rustling Petal Co. determines that another remedy is appropriate under the circumstances.

To be eligible for consideration, any concern regarding damage, quality, missing items, or order issues must be reported promptly.

For pickup orders, the customer must notify The Rustling Petal Co. at the time of pickup or immediately upon receipt. The customer may be required to provide photographs, order information, and other documentation.

The Rustling Petal Co. does not issue refunds, credits, replacements, or remakes for customer error, missed pickups, late pickups, incorrect order details submitted by the customer, failure to follow care instructions, product deterioration after pickup or delivery, exposure to heat or cold, transportation damage after release to the customer, natural floral variation, approved substitutions, subjective design preferences, or dissatisfaction based solely on differences from example photographs.

Cancellation requests must be submitted in writing.

Because production begins upon order placement, cancellation requests are not guaranteed to result in a refund. Any refund, credit, or cancellation remedy is determined at the sole discretion of The Rustling Petal Co. based on timing, product type, materials sourced, labor performed, administrative work completed, and costs already incurred.

10. Custom Orders

Custom floral orders may require consultation, written approval, invoice confirmation, and/or payment in advance.

Custom orders are subject to product availability, design feasibility, scheduling capacity, budget, and lead time.

The Rustling Petal Co. reserves the right to decline any custom order request for any reason, including but not limited to insufficient lead time, unavailable materials, design limitations, budget constraints, scheduling conflicts, or inability to reasonably fulfill the requested scope.

Once a custom order has been approved and production, sourcing, or purchasing has begun, the order is final sale and non-refundable unless The Rustling Petal Co. determines otherwise in writing.

11. Flower Bar Services

Flower bar services may include floral materials, greenery, display vessels, buckets, wrapping materials, ribbon, supplies, setup items, design guidance, staffing, delivery, setup, teardown, or other services as stated in the applicable invoice, proposal, package description, or written agreement.

Flower bar services are subject to availability, package limitations, seasonal floral availability, venue conditions, customer-provided information, and timely payment.

12. Flower Bar Booking and Payment

A flower bar service date is not reserved until The Rustling Petal Co. has received any required non-refundable retainer, deposit, signed agreement, written confirmation, and/or other booking requirement stated by The Rustling Petal Co.

All flower bar pricing, package inclusions, guest counts, stem quantities, service windows, delivery fees, setup fees, staffing fees, travel fees, teardown fees, rental fees, and other service terms must be confirmed in writing.

Verbal discussions, estimates, inspiration images, or preliminary conversations are not binding unless incorporated into a written invoice, proposal, booking agreement, or written confirmation from The Rustling Petal Co.

Unless otherwise stated in the applicable invoice, proposal, or agreement, the remaining balance for flower bar services is due no later than seven calendar days before the scheduled service date.

Failure to pay the remaining balance by the required deadline may result in cancellation of the service. Any non-refundable retainer, deposit, or other non-refundable amount may be retained by The Rustling Petal Co.

13. Flower Bar Retainers, Cancellations, and Refunds

Flower bar services require advance planning, event-date reservation, floral sourcing, supply preparation, administrative work, labor coordination, and staffing preparation.

Any retainer or deposit paid for a flower bar service is non-refundable unless otherwise stated in writing.

The retainer or deposit compensates The Rustling Petal Co. for reserving the event date, declining other potential bookings, administrative time, planning, sourcing, preparation, and other business costs associated with the service.

Customer cancellation requests must be submitted in writing.

If the customer cancels a flower bar service, the retainer or deposit remains non-refundable. Any additional amounts paid beyond the retainer or deposit may be refunded only at the discretion of The Rustling Petal Co. and only to the extent such amounts have not already been applied to flowers, greenery, supplies, rentals, labor, staffing, administrative work, sourcing, preparation, travel, or other event-specific costs.

If The Rustling Petal Co. cancels a flower bar service for reasons within its control and is unable to provide a reasonable alternative, the customer may be eligible for a refund of amounts paid for the cancelled service.

This does not apply where cancellation results from customer breach, customer cancellation, nonpayment, inaccurate event information, lack of venue access, unsafe conditions, venue restrictions, weather conditions, force majeure events, or circumstances outside the reasonable control of The Rustling Petal Co.

Rescheduling requests are subject to availability and must be approved in writing. If The Rustling Petal Co. is unavailable for the requested new date, the request may be treated as a cancellation.

Additional fees may apply for rescheduling, replacement flowers, additional sourcing, labor changes, rental changes, travel changes, administrative time, or other costs caused by the rescheduling request.

14. Flower Bar Guest Counts and Package Limits

Flower bar packages are designed based on estimated guest participation, product quantity, service level, package scope, and selected price point.

Guest-count estimates are not guarantees that every guest will receive identical floral materials, identical stem counts, identical flower varieties, identical wrapping, or identical finished bouquets.

If actual participation exceeds the contracted guest count or package capacity, The Rustling Petal Co. is not responsible for providing additional flowers, supplies, labor, service time, materials, or finished bouquets unless such additions are agreed to in writing and paid for by the customer.

Any request to increase guest count, flower quantity, service time, setup scope, staffing, or package level may require additional fees and is subject to availability.

15. Flower Bar Floral Selection and Substitutions

Flower bar floral materials are selected by The Rustling Petal Co. based on package level, seasonal availability, supplier quality, color palette, event needs, design suitability, and overall service scope.

Specific flowers, greenery, colors, branches, vessels, buckets, ribbon, wrapping paper, tools, props, or display elements are not guaranteed unless expressly stated in writing.

The Rustling Petal Co. reserves the right to substitute any floral or non-floral item as necessary.

Substitutions will be made in a commercially reasonable manner based on the package purchased, product availability, selected color palette, and overall design direction.

16. Flower Bar Setup, Access, and Venue Requirements

The customer is responsible for ensuring that The Rustling Petal Co. has timely and adequate access to the event location for delivery, setup, service, and teardown.

The customer is responsible for providing accurate event details, including but not limited to venue address, access instructions, load-in location, parking instructions, elevator access, room location, event start time, service window, teardown requirements, venue rules, vendor requirements, insurance requirements, and venue contact information.

If The Rustling Petal Co. is delayed, restricted, denied access, or otherwise prevented from completing setup or service due to inaccurate information, venue restrictions, lack of access, unsafe conditions, parking limitations, delayed entry, customer delay, venue delay, or third-party delay, The Rustling Petal Co. is not responsible for reduced setup time, shortened service time, incomplete setup, or resulting limitations.

Additional fees may apply for delays, extended wait time, parking, re-delivery, additional labor, extended service time, or additional setup requirements.

17. Outdoor Events and Environmental Conditions

For outdoor flower bar services, the customer assumes all risks associated with weather, temperature, wind, direct sun exposure, rain, snow, humidity, insects, uneven surfaces, and other environmental conditions.

Fresh flowers are sensitive to heat, cold, wind, direct sunlight, and prolonged exposure.

The Rustling Petal Co. is not responsible for reduced freshness, wilting, damage, instability, breakage, shortened vase life, or diminished product quality caused by outdoor conditions, unsuitable placement, venue conditions, or environmental exposure.

The Rustling Petal Co. reserves the right to modify setup, relocate materials, limit display elements, remove unsafe items, or decline unsafe setup conditions if necessary to protect staff, guests, products, equipment, or property.

18. Customer and Guest Handling

Once flowers, supplies, bouquets, buckets, displays, wrapping materials, tools, vessels, signage, stands, or other items are handled by customers, guests, venue staff, vendors, or third parties, The Rustling Petal Co. is not responsible for damage, misuse, breakage, injury, loss, reduced quality, diminished appearance, or dissatisfaction resulting from such handling.

The customer is responsible for the conduct of guests, attendees, venue staff, vendors, and other third parties during the event.

19. Rental, Display, and Equipment Items

Any stands, buckets, vessels, props, signage, tables, linens, tools, display structures, or other equipment provided by The Rustling Petal Co. remain the property of The Rustling Petal Co. unless expressly stated otherwise in writing.

The customer is responsible for loss, theft, breakage, damage, excessive cleaning, or failure to return rental, display, or equipment items.

Replacement, repair, cleaning, recovery, or late-return fees may be charged to the customer.

20. Delivery, Transportation, and Product Care

Unless delivery is expressly included in writing, orders are pickup only.

Once an order is released to the customer or the customer’s designated representative, the customer assumes all responsibility for transportation, handling, storage, temperature control, placement, and care.

The Rustling Petal Co. is not responsible for damage, wilting, breakage, spillage, tipping, bruising, reduced vase life, or product deterioration after the order has been picked up, delivered, transferred, or otherwise released from The Rustling Petal Co.’s possession.

Customers should transport floral products carefully, keep flowers upright, avoid extreme temperatures, avoid direct sunlight, avoid leaving flowers in vehicles, and place arrangements in suitable conditions as appropriate.

21. Allergies, Pets, Children, and Safety

Flowers, greenery, branches, berries, foliage, floral foam, plant materials, ribbons, pins, wires, vessels, water tubes, preservatives, and other floral supplies may pose risks to children, pets, or individuals with allergies or sensitivities.

All floral products and materials are ornamental only and are not intended for consumption.

Customers are responsible for keeping floral products and related materials away from children and pets.

The Rustling Petal Co. does not guarantee that any floral product is hypoallergenic, pet-safe, food-safe, or free from pollen, fragrance, sap, thorns, insects, residue, or other natural materials.

If accidental ingestion, allergic reaction, injury, or exposure occurs, the customer should contact a medical, veterinary, poison control, or emergency professional immediately.

22. Photography and Use of Images

The Rustling Petal Co. may photograph floral products, flower bar setups, event displays, arrangements, bouquets, and related designs for internal documentation, quality verification, marketing, website use, social media, portfolio use, advertising, and dispute resolution.

The Rustling Petal Co. will not intentionally publish personal customer information, private addresses, payment information, or identifying personal details without permission.

By purchasing products or services from The Rustling Petal Co., the customer grants permission for The Rustling Petal Co. to use photographs of completed floral work and event setups unless otherwise agreed to in writing before the order or event date.

23. Intellectual Property

All floral designs, product names, collection concepts, photographs, website content, written descriptions, branding, marketing materials, package structures, service descriptions, and original creative work produced by The Rustling Petal Co. are the intellectual property of The Rustling Petal Co. unless otherwise stated in writing.

Customers may not copy, reproduce, modify, distribute, sell, publish, or commercially use The Rustling Petal Co.’s images, designs, written materials, branding, package structures, service descriptions, or creative work without prior written consent.

24. Payment Disputes and Chargebacks

By placing an order, booking a service, submitting payment, or otherwise engaging The Rustling Petal Co., the customer agrees to these Terms of Service, including all refund, cancellation, pickup, substitution, flower bar, retainer, and final-sale policies.

Customers agree to contact The Rustling Petal Co. directly regarding any concern, issue, or dispute before initiating a payment dispute, bank dispute, or chargeback.

The Rustling Petal Co. reserves the right to contest any chargeback or payment dispute for orders or services that were accepted, sourced, prepared, made available for pickup, delivered, partially performed, fully performed, cancelled outside the applicable refund terms, or otherwise subject to these Terms of Service.

The Rustling Petal Co. may provide documentation in response to a chargeback or payment dispute, including but not limited to order confirmations, invoices, receipts, checkout records, product listings, service agreements, pickup details, event details, customer communications, cancellation terms, photographs of completed products, proof of sourcing or preparation, delivery records, service records, and these Terms of Service.

Unauthorized or improper chargebacks for completed orders, prepared orders, missed pickups, no-shows, late pickups, final-sale products, custom orders, flower bar services, retained deposits, non-refundable retainers, or services cancelled under these Terms may be disputed to the fullest extent permitted by law.

The customer remains responsible for any outstanding balance, approved charges, non-refundable amounts, collection costs, chargeback fees, or other costs incurred by The Rustling Petal Co. as a result of an improper payment dispute, to the extent permitted by law.

25. Limitation of Liability

To the fullest extent permitted by law, The Rustling Petal Co. shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from any product, order, service, event, delay, substitution, cancellation, missed pickup, floral variation, product deterioration, third-party handling, venue restriction, weather condition, allergy, pet exposure, customer misuse, or customer failure to follow care instructions.

The Rustling Petal Co.’s total liability for any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

26. Force Majeure

The Rustling Petal Co. shall not be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, supplier shortages, crop failures, transportation delays, illness, accidents, labor disruptions, power outages, venue restrictions, emergencies, government actions, road closures, market disruptions, or other events beyond the reasonable control of The Rustling Petal Co.

In such circumstances, The Rustling Petal Co. may make substitutions, modify services, reschedule when feasible, or provide other commercially reasonable alternatives at its discretion.

27. Refusal of Service

The Rustling Petal Co. reserves the right to refuse or cancel any order, booking, or service request at its discretion, including but not limited to requests involving insufficient lead time, unavailable materials, unsafe conditions, nonpayment, abusive conduct, unreasonable demands, suspected fraud, inaccurate information, or violation of these Terms of Service.

If The Rustling Petal Co. cancels an order or service for reasons unrelated to customer conduct, refund eligibility will be determined based on the circumstances, applicable law, and any costs already incurred.

28. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles.
